Social Security Disability Lawyers and Payments?


I am applying for social security disability. I have been denied TWICE. I filed and then was denied the first time (which I expected) and I filed a reconsideration and was denied again (didn't expect because I had 3 of my doctors supporting me!)

My question is, I am in the process of going before the ALJ and I have a meeting this week with a disability lawyer... I know they get 25% of my backpay, HOWEVER, do they get 25% of ALL of my backpay or only 25% of a PORTION of it since they are only coming on to my case in the middle, not from the very start?

Serious answers only please!

Put it into your contract with them that they will get 25% of the amount as of the day they came on board, not 25% of the amount accruing from before they came on board. They will agree to this. But, if you don't put it into a written contract they will take 25% of all of your back money.

I am not sure how they will bill, but I hope you have an attorney who specializes in SSI disability. Another responder said to put it in your contract about paying the percentage only for the period they were on board. Good advice. I hope that person is speaking from experience and knowledge and not just making a random suggestion. It sounds like they know what they are talking about - so definitely check it out. Believe it or not, 25% is good. Other areas of law, attorneys get more like 40%!!! I believe you may never succeed with your claim without an attorney, and it is a very specialized area of law that requires expertise of someone who knows the ropes. It's absolutely criminal that the process takes so long that most people suffer enormous economic losses while waiting to be rescued. And those who are truly eligible and deserving of SSI have already suffered more than their share.
