I was just grant a motion to squash arrest on a dui?


Ok the just granted a motion to squash the arrest but i still have another court date for 9-25 because the state didn't like the judge decision what does this mean in figure since they squash the arrest i should be a free man.

The state wants to ask the Judge to reconsider.

If he does, you're on the hook again.

And it's "quash", not "squash"

1. It is "quash."
2. If you called something a motion to quash an arrest, it had no meaning,but the judge probably construed it as somethin meaningful, such as a motion to suppress evidence.
3. If evidence has been suppressed, that doesn't mean the case is over, as the prosecutor can go forward with other evidence.
4. An illegal arrest has remedies, but it does not deprive the court of jurisdiction.

Motion to Quash, not squash. It means that she felt it was illegal, the arrest was not legal. She has to go to court to present evidence that this was not a legal arrest. Evidence must be presented at a hearing. Usually a motion to quash is done to suppress evidence because it was obtained illegally.

It sounds like the state is appealing the decision of the judge.
