Can i move to another state while on informal probation to get married?


IM not certain how things work under informal probation for a secong DUI in Orange County California. Under my probation i have alcohol classes, MADD class, and fees. At the moment my boyfriend and i want to get married. Hes in the airforce currently in Texas. Now what im not sure about is if im allowed to leave state and live on a base etc. transfer to another court???

Since you are on informal probation (which statutorily is called a "conditional sentence"), you don't have a probation officer, so saying you should speak to one is not very helpful, is it? You are probably going to have to complete your classes in California. I don't think the DMV accepts out of state classes, even if the court might.

I doubt that it is a condition of your probation that you not leave the state, and even if it was a violation of probation would not result in a felony charge. However, your bigger problem is the application of the Interstate Compact for Adult Offender Supervision, which comes into play whenever a probationer moves to another state. A transfer of supervision under such circumstances is time-consuming and cumbersome, and most judges don't know how to do it.

Your best bet might be to get all your classes done and fees paid, and then ask for early termination of probation so that you can leave the state without having to transfer supervision.
Short of that, the judge might simply give you permission to leave the state, ignoring the Interstate Agreement, and if you did not come to the attention of any authorities in the other state that might not be a problem.

no not until your probation is over or you would be convicted for breaking your probation then if you leave you would become a felon and there is a limit amount of time before they find you

It's simple, ask your probation officer.
