I got a dui but wasnt driving?

i got a dui parked at a gas station sitting on my car and keys where on the seat can i beat this. he stopped and talked to me because he saw my car parked at a school earlier that night and was wondering why i parked it there.

You are out of luck. You do not have to be driving a car but only in control of it. Since you were in the drivers seat, the keys were on the seat with you, and it was in a gas station parking lot then that qualifies as DUI. If you want to try and beat it then get a good attorney and who knows what the result will be.

I've heard you have to have "intent to drive", and from my understanding this means sitting behind the wheel. Though, officers and laws probably vary state to state, county to county etc. And another valid point is: did you drive to the gas station from the school in an inebriated state? If so, you're going to have to take what they give you. If its your first one and the judge is in a good mood they'll probably suspend your license for something like 3 months, make you take alcohol classes and pay tons in fines, and court costs. You could get a lawyer, it'll run anywhere from about 500 bucks to thousands, he might be able to do something for you, he might not. As for your charge I don't have sympathy but I have empathy for you. I've had one it sucked for the most part, but I learned a lot. I actually got a kick out of the classes, the teacher was awesome, thanks agape! So just ogtta take what the law gives ya.

Several DUI elements are simply missing from the direct evidence, creating reasonable doubt, depending on your state DUI/DWI laws, and the possible circumstantial evidence. Did anyone see you driving? No. Did anyone see you driving on a public way? No. Was there any other way your car could have gotten where it was without you driving? Yes. Case dismissed. Well, the question is this: How did you get to the gas station in the first place?

If you were under the influence, and had driven it to the gas station, then deal with it. If that IS the case, then I feel no remorse for you.

If you are under the influence and sitting behind the steering wheel then you can be charged, even if the keys are in someone else's pocket.

If you were in the driver's seat, you're f**ked.

Next time, when drunk, don't hang out in parking lots.
