How is it possible for a previous DUI to be "expunged" from a person's record?

I know of a person who got a DUI 4 years ago and just received another one a couple of days ago. He blew a .18 which is way over the legal limit and also got out of the handcuffs while in the police car.

He is worried that he is looking at jail time along with everything else and I hope that he does get some jail time b/c he is an alcoholic and nothing is working to change his mindset.

He mentioned that his previous attorney was supposed to "expunge" his record and I am concerned that if that happens, then this current DUI will only get a slap on the wrist without any dire consequences.

If anyone can give me some information, I would truly appreciate it.

No rude or ignorant comments, please as this is a sensitive subject fo me. Thank you.

FozzieBear, I do not understand how someone can get a DUI and then it just be wiped away. I fear that if he gets away with this again, he will keep drinking and eventually kill someone or himself.

After only four years, I doubt that the previous one could have been expunged from his record. Hopefully the second one will put him into jail. Maybe he can get the help he needs there and make our streets a safer place.

Thank you. Report Abuse

expunging your record might hide the conviction but there is a record of the arrest drop a hint to the DA they love that info,as for not wanting jail time then guess what?quit driving drunk
BTW pervious convictions shows a comptemt for the law.if the person gets on the stand the DA ask if ever arrested for this type charge and he lies boom if he admits a previous DUI then it aggravates his sentence no matter if expunged or not

they are no longer allowed to be expunged. it doesn't matter if you had a dui 20 years ago, it's still going to be considered when another violation occurs. this law has only been in effect for about 3-4 years now. he will probably get 60 days with 50 suspended. he'll have to serve 10, be on probation for a couple of years and lose his license for 2 years. that's what would happen if he lived in ohio at least.

He may not be able to. Honestly, a .18, he shouldn't deserve to either.

Why do you need for this person to suffer more than what the law allows? If his last offense was four years ago and has been expunged from his record, then that's what the law is.

Did he hurt anyone when he got his DUI? Did he do any property damage? If so, then he'll be punished for that. If not, then he didn't do any harm, so he's only being punished for what he MIGHT have done.

How would you like to be arrested for what you MIGHT do during a certain situation? People on their cell phones are very bad drivers. They cause tons of accidents, yet they aren't punished for what MIGHT happen.

Get over it.
