How is it possible for a previous DUI to be "expunged" from a person's record? |
I know of a person who got a DUI 4 years ago and just received another one a couple of days ago. He blew a .18 which is way over the legal limit and also got out of the handcuffs while in the police car. FozzieBear, I do not understand how someone can get a DUI and then it just be wiped away. I fear that if he gets away with this again, he will keep drinking and eventually kill someone or himself. After only four years, I doubt that the previous one could have been expunged from his record. Hopefully the second one will put him into jail. Maybe he can get the help he needs there and make our streets a safer place. Thank you. Report Abuse expunging your record might hide the conviction but there is a record of the arrest drop a hint to the DA they love that info,as for not wanting jail time then guess what?quit driving drunk they are no longer allowed to be expunged. it doesn't matter if you had a dui 20 years ago, it's still going to be considered when another violation occurs. this law has only been in effect for about 3-4 years now. he will probably get 60 days with 50 suspended. he'll have to serve 10, be on probation for a couple of years and lose his license for 2 years. that's what would happen if he lived in ohio at least. He may not be able to. Honestly, a .18, he shouldn't deserve to either. Why do you need for this person to suffer more than what the law allows? If his last offense was four years ago and has been expunged from his record, then that's what the law is. |
