DUI classes. Do I have to take them? |
I WAS CHARGED WITH A DUI A YEAR AGO. I WAS ORDERED TO DO 10 DAYS OF JAIL TIME ..WHICH I SERVED IN ADULT OFFENDER WORK PROGRAM. I WAS ALSO ORDERED TO PAY 1,500 DOLLARS TO THE COURT WHICH I HAVE BEEN MAKING PAYMENTS ON EVERY MONTH. LAST BUT NOT LEAST I WAS ORDERED TO TAKE DUI CLASSES FOR 18 MONTHS. I HAVENT STARTED WITH THAT BECAUSE THEY WANT 120 EVERY 2 WEEKS AND I JUST CANT AFFORD IT. I AM A SINGLE MOTHER OF TWO YOUNG CHILDREN AND I JUST CAN T AFFORD IT RIGHT NOW. WILL I GET IN TROUBLE FOR NOT TAKING THE CLASSES? WHAT HAPPENS IF I NEVER TAKE THEM? I HEARD THAT AFTER 7 YEARS IT GOES OFF YOUR DMV RECORD? IM KINDA SCARED BECAUSE I DONT HAVE THE MONEY FOR THE CLASSES AND I DONT KNOW IF I WILL GO TO JAIL FOR THIS? ANY HELP OR ADVICE? Hmmm. Still drinking? Ever think of quitting? Sounds like alcohol is causing a bit of a problem in your life YOU WILL LOSE YOUR LICENSE IF YOU DON'T. call the office where you are supposed to take the classes....tell them you cant afford the classes, but you are willing to make small payments...at least you will have made the effort to take the classes, and if you dont, the court may find you non-compliant and send you to jail If it was required as part of your guilty verdict/finding, then yes, you are required. You can be held in contempt of court for not following the judge's orders, which would equal jail time and/or more money owed. So take your classes. If the court ordered you to take the classes as part of your sentence or probation, and you violate that, you can go back to jail. Why don't you just explain to the court that you can't afford the money and ask for a fee waiver? It would probably do you a lot of good to take the class, but it won't do your kids any good if you have to do it at their expense and take that money out of what they might need in order to stay healthy. The court may just waive the fee for the DUI classes. Yes you have to take them. You are on probation. Don't you remember when you were in the court room and they originally sentanced you to 365 days in jail? In lieu of going to jail for one year, they are giving you only days jail, alkie classes and you have to pay fines. So, if you do not do any one of these things one year from the time you were sentanced, you will default to the original sentance and get locked up for 1 year. If you need help with the money part, then contact the probation office in the court and they may have assistance programs for you. theirs no way around it, you shouldnt have been driving drunk, you could of killed someone if you dont take them , it will result in loss of your license and possibly more jail time. i agree with the above said. contact the office and ask them about payments..or maybe your P.O. can help with financial arrangements. also, if you take them, you will get a slight reduction on your car insurance:) just something to look foward to afterwards! it wont come off your record ever. 120 every 2 weeks for 18 months? thats 36 hours of classes for 4300 bucks?!!!, that doesnt sound right. and if it is right, its ridiculous. these dui classes are just scams for the township to make money off you. ask the court if you can serve jail time instead. when i had a dui i did 48 hours in jail and went to class for 8 hours each day. 16 hours. theres really not much more you can learn about drunk driving that wont fit into that 16 hours. take the classes -- it's a fact of life that the court system will suspend or revoke your license, and then if for any reason cops pull you over, you WILL be taken to jail. it is also a fact that people driving on a revoked or suspended license has become so prevalent, that cops now do spot checks the same was they check for drunk driving. you will have to find SOME way of getting these classes. Sooner or later the cops pull everyone over. it doesn't take much, and your children will suffer if you are put in jail. Try this: find one of those "first session free" lawyers, call, and ask. You won't get your license back. YOU CAN TURN YOUR CAPS LOCK KEY OFF NOW. If they are ordered by the court,yes. Either go, or lose your license yes you have to take them, contact the court to see what your options are. What state do you live in? I got nailed for DUI in 99 .ITS OFF MY RECORD NOW. You can get ahold of whatever class your going to or are suppose to go to and ask them what they can do or what free classes there are. |
