Civil court/ criminal court question serious people please answer?


Here is the deal i am due in civil court in 2 weeks for an estate case that went bad. i was also charged with a criminal theft charge for the same estate case. the criminal charge i was told by my lawyer he got a plea bargin for me. i will have 3 years prison time suspended except for the time i served already, 3 years probation, and i have to pay retitution. now the question is when i go to civil court what should i expect to go through since i am already going to be paying restitution for the same thing? am i looking at more jail time? or just finalizeing the case so they other judge knows how much i have to pay.

This is an attempt to insure they will receive some money from you.

First, civil and criminal courts are completely separate, and have different levels of proof.

Criminal courts require a proving beyond a reasonable doubt. You can go to jail if found guilty.

Civil courts require a lesser proving of more likely than not. You can't go to jail, only pay money to someone if found guilty.

All they will need to do in the Civil Court is show the criminal proceedings which already exceed the standard necessary to win in civil court. They will receive a judgment against you, and then they can garnish wages, sell your car, house, etc.
