Question regarding public criminal records? |
Does "Court Dismissal" next to a charge on your criminal record constitute a conviction set aside, expunged, or vacated? Or was the charge completely dropped before a conviction? It means that the charge was dismissed from the court, canceled without penalty. It could be for a number of reasons such as the count was laid improperly (against the wrong person), there was some procedural error made during the investigation that would have the case thrown out of court, the DA withdrew the charge or for a host of other reasons. It is supposed to be without prejudice against the accused. A court dismissal is not really known as a expungement. Most dismissals are also known as the legal term nolle prosequi. If this is what you received, then the prosecutor did not wish to pursue the case. Either from lack of evidence, proof of no guilt herein, incorrect filing of case, and so on. I would speak with your lawyer because just a "Dismissal" doesn't explain what type of dismissal the motion came through. Good luck! |
