Consumer rights question.?


Can HP change their price or not? On the one hand they say the price is fixed at the time of acknowledgement of the order, but they reserve the right to correct the price any time prior to Delivery where there has been a typographical or other error in the price.


"PRICES
a) Prices are inclusive of GST and exclude Delivery charges unless otherwise indicated on the order form and are valid for the period indicated, subject to paragraph b). The final price will be fixed at the time HP sends its acknowledgment of your order. You must notify HP promptly of any errors or omissions of any kind in payment terms, including price, contained in HP's acknowledgment.

b) HP reserves the right to correct the price at any time prior to Delivery where there has been a typographical or other error in the price. HP shall notify you of the corrected price. You may choose to pay the corrected price, however if you do not choose to pay the corrected price, then HP shall have the right to cancel your order without further obligation to you.

"Fixed" as in,, the same sense as if you would have said " I had my cat fixed". It means you can't use the product to reproduce other products of its same kind. HP cannot therefore change their products or enable them to be cloned and reproduced unnecessarily, other than if you had accepted the original uncloned order. I believe you have every right under the RSPCA guidelines to not have your HP product you want to buy, fixed in any way, which would prevent you from further abusing your rights as an unsuspecting, (albeit naive) internet purchaser.. so you accidently hit the 'buy' button, so you accidently purchased the erroneously priced product with your credit card, and unknowingly, and unsuspectingly bought a product which was incorrectly labelled. It's not your fault, it's theirs. You could claim you were drunk at the time, you could claim you have an ongoing mental illness or sleep disorder such as 'sleep internet buying'. Whatever the situation, I think you have a strong case for legal representation should you wish to take this further. Your rights as a consumer are protected under the Law, and HP cannot over-ride that consumer law by placing disclaimers or "reserve the right" statements on their websites. Got me.....I worked at K-Mart and I had to take everyones word on what they thought they saw in the paper....on the sign....on the switched ticket....now who knows? I don't think consumers have any rights anymore.
