Can an employer make you go oversea do due work in the middle east? Are there any laws protecting Americans?


I have a friend that does construction and was told he has to go to the middle east to do a project. He works in a management . Are there any laws that protect Americans for an employer to make an employee to go to an area where there is possible danger? He is afraid if he doesn't go he will be fired.

Sorry, but if is is given a work assignment and refuses, he runs the risk of being terminated.

That said, it would depend on where the work assignment is located and if this assignment is a US Government contract.

Most contractors in the Middle East are banking $100-400K per year including bonuses. The first $85k (2008) is tax exempt.

The other responses are correct. My point is that unless they want him to go to Iraq or Israel, what is the problem with the Middle East? It is no more dangerous to be in, say, Dubai, than it is to be in places in the US. Even places that sound worse, such as Egypt or Jordan, are perfectly fine. Is the location he has to go to particularly dangerous?

No, they cannot make him go to the Middle East. That would be slavery, and is illegal.

However, unless he has an employment contract that says otherwise, they can "tell him" to go there, and if he says no they can fire him.

If he has a contract for a specific period of time, and that contract specifies his duties, he can enforce the contract. Otherwise, both parties are free to negotiate the conditions under which he will continue to be employed.

They have a right to fire him if he won't cooperate. There is no involuntary servitude in the United States. They can't make anybody work.

He has the choice of taking the assignment or resigning. When you work for a company they can assign you to where they think and employee will best fit. Sorry

He has the right to quit. I am sure that when he was hired, that he knew where the company did work.
