My son just got attacked by a dog where he was doing construction work. what can he do to make the owner pay? |
for the expenses. the neighbors dog came on the other property and bit his calf and tried to attack a second time. the dog was not provoked. the owner is assuming no responsibily where i live if you get bit by a dog and you go get medical attention you are required to contact the animal control too. then they go and get the animal to make sure it doesnt have any diseases and is up to date on its shots. as for the expenses i would think you could probably sue the homeowner's insurance. that's what a friend of mine did. get a lawyer and take pictures of the injuries he can sue the owner of the dog. Was the dog attack documented by police? If you haven't done that part already, make sure you have your details straight and file a report with the police right away. It sounds like this dog is trained to attack if the owner assumes no responsibility for an unprovoked attack by his dog that was obviously off of any leash or restraint. It would be best to have the attorney send them a letter first. People get scared when you have an attorney send them letters. First, take pictures of your son's leg. Then try to take a picture of the dog in the owner's yard, to prove it is his dog. Take those to court and sue the man. If they don'tn pay - sue. Judge Judy is a good way to humiliate them even further. The dog doesn't have to be provoked if it bites the owner usually has to pay. Did he call the police and go to the hospital for treatment. If so have him either take the claim to a small claims court or file charges. Report the dog attack to the police. You need to call a lawyer ASAP and make sure you have Doctor's notes, Photographs, and anything you can possibly get. You guys might just be looking at a pot of gold ! Take pictures. File charges. Take him to small claims. Hope there is a leash law in the area which good chances there are. Either way the dog was trespassing on the other property when it attacked. It's the dog owners fault for sure. The first thing you need to do is file a report with the police. SO it is on file, you must do this. THen what will cover the damage if I remember correctly is the owner of the dog. The owner of the dog's home owners insurance. They are liable it does not matter if he provoked the dog or not. He injured your son and that is what home owners insurances are for. Tell the owner to pay. Call the police and file assault charges. The dog's owner will have to pay for all expenses and may even get some jail time. He is responsible for his dog. |
