Do I have the right to build a parking pad on my neighbors property if...? |
Do I have the right to build a parking pad on my neighbors property if I benifit from a "Easement Premise" and as long as the pad does not disrupt the property of the neighbor? The desciption says that the uses permitted include use permitted by applicable zoming, and also includes without limitation Construction, Location and use of a Hot tub, patios, dog houses, trellises and similar improvements. I may not however use it in any manner to unreasobly disturb the Owner of the lot. It breaks down to this, as long as the access to the easement hasn't been restricted, you are fine. But you can get into a mess if your neighbor has a problem with how new construction would marry to in their property. Putting a parking pad on his property even if it is an easement is unreasonable disturbance. It's still his property. Why don't you build it on your own property? |
