What if I say n***** while hitting a black person and it is considered a hate crime? |
However, if the gov't is prosecuting me for something I said isn't that a violation of my 1st Amendment rights? Yes, the can prosecute me for the assault, but to tack on the hate crime part of it seems to be in violation of my Constitutional Rights. It is unconstitutional to be prosecuted only for the speech. But here you are being prosecuted for the assault and the speech is an enhancement to the charge. Each state has their own laws regarding the issue. I guess hussein is first on the list. Well if a black man can call a white man a cracker or honkie or whatever, of course I'll be calling them the N word. They wont do anything. Hate crime laws are disturbing and stupid Sorry, your rights end at the tip of the other person's nose. you are free to argue that in court or on appeal if convicted. the issue has been raised in the past - not sure if SCOTUS has ruled on the issue or not. Affirmative. Your thoughtcrime would be doubleplus ungood. Yes, you may feel like the charge you are facing is contradicting to the First Ammendment but look at it from the other side of the fence... If someone called you a racial slur and smacked the hell outta you, someone would see it as the same offense.. Choose your words wisely. Yea, we're in America; the land of the free... but we all know EVERY ammendment can be challenged in the court of law.. There are always loopholes. Im sorry wrong room... looking for the "I Have A Life" or "Im tired of Racist Questions" room! Despite 10000 cases a day of black on black, and black on white crime.... any crime between a white and black is OBVIOUSLY fueled by your "hate". you are hella racist |
