What if I say n***** while hitting a black person and it is considered a hate crime?


However, if the gov't is prosecuting me for something I said isn't that a violation of my 1st Amendment rights? Yes, the can prosecute me for the assault, but to tack on the hate crime part of it seems to be in violation of my Constitutional Rights.

It is unconstitutional to be prosecuted only for the speech. But here you are being prosecuted for the assault and the speech is an enhancement to the charge.

Each state has their own laws regarding the issue.

You can do it and appeal the conviction all the way to the supreme court. Then the rights hating conservatives on the highest court can decide your rights for you.

you are free to argue that in court or on appeal if convicted. the issue has been raised in the past - not sure if SCOTUS has ruled on the issue or not.

If not, I wouldn't hold my breath on that argument keeping you out of jail - by the time it is decided, you would likely have served your time anyway.

Yes, you may feel like the charge you are facing is contradicting to the First Ammendment but look at it from the other side of the fence... If someone called you a racial slur and smacked the hell outta you, someone would see it as the same offense.. Choose your words wisely. Yea, we're in America; the land of the free... but we all know EVERY ammendment can be challenged in the court of law.. There are always loopholes.

Hate crimes are a fraud. The problem is that no politicians have the BALLS to stand up for fairness out of fear of being called a 'racist'. I suggest you prepare for the worst.
