Is it defamation of character?


I was recently at a job for a well known computer company. I was hired through a temp agency. One day after leaving work I recieved a phone call from my temp agency finding out that my "contract" had ended. I was in the process of filling for unemployment when the lady calling informed me that certain supervisors claimed that I was using fowl language and being disrespectful to my other employees. This was not the case at all. Could I sue the computer company? Do I have a strong case?

Probably not. In most cases, unless you had a employment contract, you can be fired for no reason at all. That doesn't mean they can fire you for ANY reason, but they don't have to have one. If there was some evidence that you were fired based on discrimination(race, religion, sex. etc.), then you would definitely have a case, but you didn't mention anything like that and you would need some sort of evidence.

Depending on your states laws, you may be eligible for unemployment. In fact, for the most part the only thing that would disqualify you from unemployment would be if you did something illegal or that violated company policy, and this would also require some sort of evidence....or you just quit.

It is also based on the length of you employment and most employers have a "probationary period", in which they can fire you for no reason and not have to pay unemployment. A good indicator is if you were involved in any sort of employee benefit package, it would establish that they considered a long term employee.

If you had never been written up for what they are accusing you of then they essentially have no evidence. Unemployment is not going to interview your former employees or anything like that.

I suspect that there are some other issues due to the fact that you were involved with temp agency but I really have no idea. I only know this much because my girlfriend was recently fired while she was on disability for no reason and she had been working there for over a year. We were sure that we had a big case and spoke to a lawyer, but came to find out all she was entitled to was unemployment. It was alright though because it was a small company that is not doing well financially and they were paying her way more than she could find again so they are going to pay her $2000/month to do nothing for 6 months.

Apply for unemployment and see what happens, but unless you live in a state with very generous employee protection laws that is probably all you will get, if anything at all.

The term you are looking for is slander, and, pending the testimony of witnesses, you may have a case here for just that.

You can sue the computer company but you would have to prove slander and you would have to prove damages.
