If a guy chats online with a girl he thinks is 19, but it turns out she is really 15, what can happen to him? |
My friend is 23 and he was chatting with a girl he thought was 19. The girl's brother hacked into her computer and is now threatening my friend. If this went to court, my friend could get into a lot of trouble.....but since the evidence was acquired illegally (hacking into your sister's laptop is not legal is it?) wouldn't there be cause for dismissal of the case? Its not illegal for a brother to use his sister's computer. I use my sister's computer all the time. the only way it would be illegally acquired evidence is if the police had hacked into the computer without a warrant. If the brother gets on the computer then freely gives the information to the police, then this is not illegally acquired evidence. It's not illegal to chat with an underage girl. Unless he said something explicit, then no charges can be filed to begin with. everything depends in what state you live in... but since the older brother is threatening your friend then chances are there is some sorta script for all the conversation they have had.. Your friend needs to see if he can get those off his computer as well, b/c if it clearly states her saying she is 19, and they have ONLY talked on line, then nothing can happen to him.. If they have met off the internet, then that's where it differ's by each state.. but either way, if i was your friend i would totally STOP talking to this girl, b/c she is only going to get him into BIG trouble!!! all you have to do is have proof she told you she was 19 an email or an im or anything where she clearly stated her age as 19 or get her to admit it to the cops herself it could also help if you go up there and explain the situation and tell them how the brother is threatening you chances are they will believe you if you go up there and tell them before they have to come and find you and no unless her broke into a safe she specifically said he couldn't go into and took her comp. its not illegal anything in their house is considered "their" property also if your friend never said sexual things to the girl or that he wanted to meet her for that reason theres no problem Your friend needs to have a lawyer ready. There's alot that a judge would consider....Who started the conversation the very very first time they spoke. Did both parties state how old they were from the beginning and were they honest? What was discussed? If it was harmless subjects then the friend has nothing to worry about. If there was talk of meeting and doing things adults do, your friend could have a problem. he wouldn't get in trouble unless he had sex with the girl, then they could file charges. for all you know this is just 1 person being a twat who was pretending to be a girl in the 1st place and is now pretending to be her brother. or the girl might have had 2nd thoughts about getting involved with someone online so made it up. That is why you have to be careful who you talk to. If he has proof that she said she was 19 and he REALLY had no idea of the truth he should be fine......if not get a lawyer...PS hacking into your UNDERAGE sisters computer is NOT illegal Do they have your friend's information like his real name and where he lives? Did he continue talking to her after finding out she's 15? Tell your friend to call legal aid for advice A 19 year old is allowed to talk to a 15 year old. Last time I checked, having a discussion is not illegal. |
