Went into email account w/out permission and forwarded emails to use in court? |
can someone go to ur home, get on your personal computer and go into ur email and forward ur emails to themself to use against you in court? They went snooping without permission. Will the emails be permissible in court? This is an ex who does not live with me. Would not return the key and he is not on the lease.Was in the process of getting locks changed. He committed a federal offence - accessing a computer system without permission - so you can report this as a crime. Once you've done that, you can challenge the admissability of the emails in court. Since you probably can't prove that you didn't send them, they may be admissible if they pertain to the case. NOT IF YOU CAN PROVE THAT THEY STOLE OR GAIN ILLEGAL ENTRY TO YOUR COMPUTER. The answer may depend on who "someone" is. If it is your spouse, then, maybe... if it is your spouse's lawyer, then maybe not. They need a warrant for evidence from you. Also you can just say it was all made up, since you did not send it so you cannot verify that they were at all yours. It'll just get thrown out. your questions are really ambiguous. No one can suggest what to do unless you provide more information. |
