Can I sue a collection agency? |
I have paid my cond taxes over a year ago. The collection agency has never contacted me that there was any balance due. I have copies of my checks, I have copies of my phone bills where I have called the agency for the last year. There is always only 1 person there I can talk with who is handling my account and she has never ever called me back. I call twice a day and no luck. She knows she needs to release the account but she just will not do it. I want to sue them for the loss of not being able to use my cond for 2 years and for any attorney fees and whatever stress this has caused me and my family. This is just awful since it was paid in 2007. What can I do?? Thank You This is a time share we have in florida. I live in Indiana. These were for the taxes and maintenance fees on it. I have copies of everything and all my cell phone calls to them so I feel good I have enough. I just want to be able to use our condo. Does that make sense? When you say "cond" taxes, do you mean taxes on your condominium? If you live in the US, all states have county's (with the exception of Louisiana which has parishes). The countys keep tax records. Perhaps this is a source to look up and confirm that your taxes are paid and up to date? You can send the county copies of proof that you are paid up and current. You can sue anyone over anything. Any good lawyer will find something to sue. The question is, will you win? or will you just waste money? I'd say don't sue, and deal with it. But if you're really in to it, consult a laywer i think you can sue anyone if you can prove your case and that you suffered a loss... if i were a judge i'd rulle in your favor... GOOD LUCK yes you can sue them , take them to small claims court. Yes, get a lawyer and sue. |
