Is an attorney needed to file an affadavit for collection of small estate in AR? |
My dad dies & I am sole heir and executrix named in the will. His will states that I note be made to report to or make settlement with any court. I have researched what seems to be the simplest way to handle getting the only real property he owned which is a house with a mortgage, cleared for sale by filing An Affidavit for Collection of Small Estate by Distributees. Now, my questions is, can I do this myself? If so, how? I got the clerk to send the form... An attorney wants to charge $1000 to handle this and it seems like the only thing he would do is file in the form with the info I provide and take it to the courthouse. I don't see anything there that requires an atty for filing; did you ask the probate clerk? I'm bettting they can tell you if it must be filed by an atty or not. |
