I have a new cell #,capitol one keeps on calling me, can i file charges? NEVER had an account with them!-Brian


And, i've called 8 times spoken to 10 different people from which they tell me okay sir we'll take your number off the account. Then today i talk to a supervisor and she says, that they cannot take numbers off accounts until the name of the person on the account contacts them with a new number, but in the meantime i continue to receive phone calls-3times a day!!....now, i know once you tell a collection agency that they have the wrong number, that by law they have to make the number bad, i know because i work for ACS,- i'm a manager, and was recently in collections--student loans. So, i know that much, then why are they still calling me, it's gotten to the point when i'm like....aghhhh!!...u know? sorry about all the typing errors, i'm kinda in a rush. but if you can please answer this again before they call that would be great! Thank you!....

search the sight for a drop dead letter.
If the debt is not yours send the letter, them they will stop calling you. If they don;t record the calls and you can report the in violation of the Far Debt Collections Act.

In the mean time, Have fun with them. speak in accents, be confused, ask if they are naked....

Sure, however if you do not take the actions required by law you will lose. You need to notify them in writing that they are not to call that number.

Send them a certified letter detailing your phone number and make it extremely clear in the letter that they are not allowed to call you anymore.

If they call again, they are in violation of the law and open to civil lawsuit from you.

I don't take the calls from 800#. My voice mail states that I will only return calls if they are for me. If I don't know the number it goes to voice mail.

Tell them, in no uncertain terms, that what they are doing is harassment. They cannot call YOU to demand payment for a debt that belongs to someone ELSE. Let them know that either they stop calling you, and find some other way to contact this other person, or face legal consequences.

Make sure to inform them of your experience, as well. They're more likely to comply if they know that they're dealing with someone who's familiar with their tactics.
