Can you sue your insurance co. for harassment? |
My health care provider is not paying a bill that they agree they are responsible for. I have had the issue resolved no less than 5 times by different claims experts. Yet i still recieve a bill after I have been told it was paid. Every month for the last 9 months I get a collections notice then i get it resolved and then it starts over. Can I take them to small claims court for defamation of character, and time lost at work as well as my 120 dollar phone bill? Small claims would be tough, but there is this thing called Bad Faith Refusal to Pay--a tort that makes insurers liable if the deny coverage in bad faith. To the extent that they have denied coverage a number of times, and then have reversed themselves, that may be an option. i recommend that you sue them. all insurance are slackers, they dont really care about unless you take action against them. maybe if you sue them, they will become a better provider in the future. This appears to be a collection problem... There are federal debt collection laws that may cover your case. |
