Is Shredding someone elses mail illegal? |
My Boss had a lady work for her a long while ago (probably over 6 months+) well this girl forwarded her mail to my work and my Boss was ok with that. She apparently told my boss to shred her mail that comes in. Well the responsibility was put on me to do this (as the shredder is closest to me) So the receptionist brings her mail to my inbox and shreds it. Before I shred it I make sure it says her name (or husbands name) in the window of the piece of mail...Most of the items I notice are from collections, bill collectors and junk mail (as it looks like)...is this even legal for me to be shredding this persons mail that I don't know, but apparently she told my boss it was ok to shred it? Destroying mail is a felony. Write "Return to sender - Adressee unknown" on the mail and stick it back in the mail box. I don't know what to say except I would not feel comfortable about it. Of course it's illegal: interfering with the mail in any way is illegal. Your boss is hanging you out to dry. Refuse to shred any more and tell her the police would be interested to know about her activities. (Look for another job first!!) It is illegal if she reports it and isn't okay with the shredding. Just write return to sender--unknown addressee and put it back in the mail and they will eventually stop sending them. as long as you have her spoken consent (written consent would be so much better) then its ok and is not illegal. I would just do return to sender...after a couple return to senders, the postmaster will see that they do not receive mail there and will just do it themselves. In the States you are safe shredding 3'rd class mail. Junk and ads. First class you may not open without permission. Get it in writting that you have been ordered to shredd this persons mail. Oh I don't think that I would be shredding any ones mail. It is not legal to tamper with mail. I would just write on it "addressee unknown" and give it right back to the postal worker. It is a federal crime to destroy the mail of another person. Shred all the 3rd class and then send all the first class back to the sender. |

I agree with David as well. Get a lawyer. Having said that, if you choose to do this yourself, you answer must be a legal answer as to why you don't owe this money. A couple of things: 1. Yes, they can garnish you pay check, your bank account etc. 2. Don't tell them where you work. When you make payments send in money orders not checks so they don'... If the debt collectors try to enter the property to repossess Burtwood's goods, they are committing a trespass against Jim & Edna. Second, the collectors cannot take Jim & Edna'... I am just guessing, but I would have to say it is per person, as the judgement was against all three of you.
