How do I file an Answer to a civil case? |
I am getting sued by a collections agency. I have this form to file an answer on the case. How do I fill out the form properly? Any ideas on what my answer should be, this is my main question? I agree with David as well. Get a lawyer. Having said that, if you choose to do this yourself, you answer must be a legal answer as to why you don't owe this money. If you file an answer that says, "I just need more time to pay" for example, it will just get tossed out. Same with, "I want to work this out, but they won't talk to me." Your answer must clearly deny owing the money, or state that the amount is incorrect for whatever reason. Fill in all blanks on the Complaint form. You are the Plaintiff and the person(s), company, or other entity you are suing is the Defendant(s). Complete all necessary information on the form. If you are filing against multiple Defendants in the same action, list all of the Defendants. The Court will keep the original If you are unsure on how to complete the form, you should consult with a lawyer. Otherwise you are going to get creamed. They are bringing a lawyer. make sure you answer each complaint thourougly. Like count I: answer.... the defendent does not owe __ because ______... What your answer should be depends on your defence. |
