If you sign a form agreeing to a service but do not get the service can you still be charged?


I recieved a free Gold's Gym membership for life and added this package to a the new part of the gym before they were finished building it. It was $20/mth and I signed a contract but never went to Gold's Gym at all. I never spilled a drop of sweat on anything or even seen the equipment. I was sent charges in the mail because I didn't pay them and now I'm in collections. Do I owe them for a service I never used?

It is a question of contract law... if a collector is harassing you send them a letter in which you state the contract is now void and there exists a dispute with the prime contractor. The collector must, by federal law, drop your account and return it to the business of origin. THEN you can argue with the Gym, not some collection agency, keep EVERYTHING in writing, do not EVER discuss the matter over the phone. You can then send a notarized cancellation of signature to the Gym. You will eventually win.

You agreed to pay the bill. It wasn't a service per say that they were providing, it was a membership.. It is a moot point that you never went to the Gym. You still (unfortunately) have to pay. Although, if the account has been sent to collections, you can dispute the account and possibly settle it for less than what you actually owe. (Most collection agencies 'purchase' your debt for significantly less than you actually owe.) Good luck!

You signed a contract that made the gym AVAILABLE to you. If you never went, that is not their fault as they made the gym available. Unless they took to long to open the new part of the gym (and that is written in the contract) you owe the money.

yes.

you could refuse to pay if you weren't allowed to go to the gym. but if you made the decision to not use the gym you still have to pay.

they still provided the service, you just chose not to use it.
