How should we handle this?


We had a $900 dollar bill with a credit card company made two payments and got the bill down to $490 after our payments posted and we got a statement from the credit card company with the posted payments they sent it to a legal collections department. Now the credit card company says we didn't pay. It was paid with a debit card but we have since closed that account. If we are taken to court is the statement with the two payments on there proof enough that it was paid? Do we have to prove that we paid it beyond their statement or would they have to prove we didn't? Dirty credit card companys!

Your bank statement with the payments posted will be enough to prove that the payments were made, and that someone took the money out of the account. From there, the credit card company would have to dispute that the bank falsely posted those payments, which would be very difficult for them to do.

What you also need to do is if you pay by debit card anything, write down the confirmation # they give you for proof of payment. I always log that number right in my check register in the entry for the payment. That way the info is all in the same place, and I can produce the date paid, if it cleared or not, and the confirmation number if the payment is ever disputed.

If you got statements from the credit card company that you made payments, and your balance had gone down, use them as well to prove that somewhere there were payments made.

Even if your bank account that the payment was made from is closed, you can still get a copy of the statements showing that the payments were honored (usually a small fee is charged) if you can't find the ones that the bank sent you. You need proof that the payment was honored because most credit card companies post your account with the payment, but then if your bank denies the payment because you are overdrawn or the account is closed before the payment is honored, they will re-debit that amount and usually a fee for a dishonored payment. Send them a copy of the bank statement(s) showing that your bank honored the payments and all should be right with the world. Make sure you keep a copy of all your correspondence and a record of any phone contact. Let them know that you are disputing the re-posting of those charges and are collecting the documentation. That should suspend their action long enough for you to get the copies from your old bank.

as long as you got proof and it will say who was paid from the debit card on your statement and the dates etc.. and i would also try to get the bank to give a printout of that card around the dates it was paid also
