Whose responibilty is it when a medical lab does not submit claim to insurance co. required time (ove6 months) |
I am getting collections letter pertaining to medical lab work, eventhough I have insurance. The lab work was performed in 12/05. The lab did not send a claim to an insurance company unitl 07/06 (over six months later); the claim was in turn denied due to the fact that it was submitted late. Am I responsible for for this bill when proper precedures were not followed? I believe that the patient is always responsible for medical bills ultimately. I'd say no. But you may end up fighting them in court. Went thru this with ahospital. Finally told them to shove the bill. The put a bad mark on my credit report. My lawyer got that fixed and made me 150 grand in the bargain. I would think it's the lab's fault but I wish you lots of luck in trying to resolve this one. Insurance companies only like premiums , not pay outs. I would say no. Contact your insurance company and have them deal with this. It is their problem if the lab is a contract company with them. My gut says that you are not responsible. But best bet would be to consult a lawyer and find out. |
