My sister has a collection place after her, does the statue of limitations stop collectors?


from claiming a dept that is past 7 years? This dept stemmed from when she was married before hand.

The statute of limitations on contracts is four years. If she was not sued, or a judgment entered against her, she has a valid defense.

Yes and no. They can not report it to the credit bureau seven years following the last activity on the account. However they can still contact you and ask you to pay it. You can obviously tell them that they are not permitted to call you and they must comply. Additionally, they would not be able to get a judgment because they did not bring the case in a timely manner.

The ONLY way to give you a relevant answer is to know in what state the debt was made and when the last activity was on the debt. (in other words, her last payment)

Also, what TYPE of debt is this? Some debts have different statute of limitations and the last question is, was she out of the state/country for any length of time during owing for the debt?

There is no time limit. They will hound her until she pays up.

Sooner or later, they will take her to court and will get the authority to attach her bank accounts, pay checks and any thing she has of value - like her car....until they get their money.

You are not allowed to steal money....and that's what she has done.
