My sister has a collection place after her, does the statue of limitations stop collectors? |
from claiming a dept that is past 7 years? This dept stemmed from when she was married before hand. Yes there is a statue of limitations check out the web site below its very good information ...... Your sister is being hounded by a junk collection agency The statute of limitations on contracts is four years. If she was not sued, or a judgment entered against her, she has a valid defense. Yes and no. They can not report it to the credit bureau seven years following the last activity on the account. However they can still contact you and ask you to pay it. You can obviously tell them that they are not permitted to call you and they must comply. Additionally, they would not be able to get a judgment because they did not bring the case in a timely manner. The ONLY way to give you a relevant answer is to know in what state the debt was made and when the last activity was on the debt. (in other words, her last payment) There is no time limit. They will hound her until she pays up. |
