Is it legal for a collection agency or group to seize your accounts with out making an attempt to garnish you? Yes it is. Look for a document called, "writ of Exemption" and have it ready for when they attempt to garnish you. You can still fight it. In California at least It depends which state. Some states allow this procedure but most do not. The collection agency has to make an effort to collect first. I would call the Attorney General in your state (it would be at the state capital) to get the answer. It could be that this collection agency broke your state's law. Then you would get the money back. Call him or her today. no, a claim has to be filed in court first, then a judgment has to be granted, then you have thirty days to comply before they can take any action |
