Can I act as a Collection Agency?


I was wondering if this is completely legal and I would not have to have any licences or anything else to do this.

A person has requsted that I collect money from a person that she has lent it to. To me, it seems simple, sending out requests and getting the money in the end. (The person would pay me a percentage).

Do I have legal right to do that?

Okay, maybe I worded this wrong

Not act as a collection agency, but just ask the person to give the money.

The person who will hire me is out of the country and it would be easier for me.

Would it be considered harrasment if I am sending legit things?

No, it is not legal for you to "act as a collection agency". The collection industry is highly regulated and requires at minimum a business license. Since you would be collecting a fee, that makes it a business.

The laws that surround collections are VERY complex and vary between each state. One stupid mistake could cost your friend the entire debt.

Your friend as a private individual collecting a debt owed her has some additional latitude, however she would be better served to take the debtor to small claims court and collect the money there.

"Not act as a collection agency, but just ask the person to give the money." - If you are being paid to do this, you are "acting as a collection agency"

Why dont she just go get the money herself?

No, you'll be harrassing the debtor and if taken to court the debt will be dissolved.

collection agency's get that bad rap because after 350 phone calls you finally pick up the phone and they scream something like PAY YOUR ******** BILL YOU C_CKSUCKING C_UNT. and rightly so. do you actually think someone will pay when you send out your very first respectful letter? idiot!
