Has anyone ever won against a collection agency like NCO who handles MBNA, will judge favor me or them?


what can i say or do to win? my case is scheduled sometime later? i am low income, why should i pay 6500 for a 1500 dollar item that was sold to me? plus the product did not even work!

Hello Susie, I tried to email you but could not. I agree with you, people who buy things they can't afford disgust me. Like suburban families who file for bankruptcy just so they can stay in their home at the taxpayers expense and society pays higher retail prices for all the companies they don't pay back. I HAD the 1500. However, I had to buy an entirely new item just to replace the one that didn't work and got behind in payments on the garbage value one they sold me. I had 1500 not 6500. Life is not about owing people and ripping people off, if I charged you 6500 you would laugh at me and call me a con artist no matter how old the debt was or the item.

If the product never worked you should have returned it. Don't even bring that up in court as it will look like an excuse.

You should be prepared the day of court to pay the original $1500 but no more and tell the judge thats all you can afford (be prepared to back this up with financial statements from your bank, a copy of your mothly budget, etc). Express remorse and say you have learned from this situation and are desparately trying to get on the path to being a smart credit consumer. He/She may or may not agree, but should work out a payment plan for you if you have to pay back the full $6500. It will be on your credit report for 10 years from the date it is paid in full. Then work hard, pay back the debt and do desparately try to get on the path to being a smart credit consumer.

The quality of the item has no bearing on the case. You will lose, so get ready to pony up some cash. Next time, pay your credit card bill.

Have the proof in your hands that it never worked. MBNA isn't responsible for that you should have returned it. But all the extra charges are a bunch of crap the Gov't allows. Make sure when the court date appears that you can say I'll pay the 1500 but no more. I tried but these shark said no...

That is pathetic -- you rack up a bill then want welch out because of buyers remorse.

You bought it, your debt, YOU NEED TO PAY.

If your so damned low income then maybe you shouldn't be buying **** you can't afford.

I don't know the specifics of your case so it would be hard for me to comment. Here is what I can tell you.

If you made the charge and it is valid you should pay for it. The fact that the product you purchased didn't work is not relevant. If you bought a defective product you should have returned it and kept any documentation for the return and subsequent credits you were due.

My question to you would be, what is the original date of the charge, and how long passed before you began getting notices. If its been awhile you can argue that the statute of limitations has expired. As an example if you made the charge in 2002, and they wited unitl 2006 to go after you.

I've had some horrible experiences with NCO. they've stolen money out of my account without my authorization and then denied that they did it. This company also has a really terrible reputation and is notorius for doing things like this. You can get information from the better business bureau, and possibly bring it to court. It may help it may not.

Oh, grow up. Your original bill was apparently 1500.00 and now is 6500.00..that is called PENALTY AND INTEREST for not paying your bill. What makes you think you are entitled to get something for nothing.

You won't win against them in court. The judge will order you to pay and if you don't, they will seize your bank accounts, paycheck and anything valueable you own until the debt is satisfied...and...oh yeah, you will also pay their court costs.

The credit card companies have the whole thing down pat. They do not lose in court - ever. You are about to get a huge wake-up call - and your credit is going to be shot to he11 for years.
