How do you go about suing a collection company that has called our home before 8, left a message on the answer


This company has called before 8 am. Left a message and I have the message stating the time. This same lady called the other night, my daughter answered, (who is taking criminal law in college) and told the lady (who asked for my husband) that he was not home (which he was not). The lady asked if this was his wife, whom my daughter said yes (for a paper for her class). The lady did not ask for any proof that I was his wife. My husband is the only person on the account she is calling for, I am NOT on it. My daughter pretended to be me, the lady did NOT ask any other verifying questions, just told my daughter that my husband owed 1400. and would I be willing to set up payments and why was he behind and discussed this account with her. Can I sue this company and how do I go about doing it? Thank you.

No nothing can be done. Legally they can call your house between the times of 8am and 9pm. I realize that she called before 8am but it happens. Just because your husbands name is only on the account it doesn't' matter who they get their money from. They can talk to a spouse and make payment arrangements that way. My daughter was behind on her credit card and when my husband stated she wasn't home they asked if he was her spouse and he said yes and he set up payment arrangements for her. Doesn't' sound right, but I don't think you can do anything expect pay the bill. Good luck and God Bless

Clearly you need an attorney who is familiar with the practices of these slimeballs. Next you need as much documenation to show that they are harassing you, taped messages if you still have them, copies of any letters they sent you.

I am in the process of suing a collection agency now, for a credit card that isn't mine and I spent an hour or so on the phone faxing my documentatoin and discussing options.

I agree with left, contact a lawyer. there is a specific collection agency calling homes pretending to be attourneys. they have harrassed people at home and at work. they have even tried to make my life a living hell and I'm not the person the were calling about(that person doesn't even live in the same city as i do)they have been causing many issues with many people around the USA. i can't remember the name of the group but you definately need protection. I don't trust any collection agency anymore. best of luck.

if your daughter is really taking criminal law why hasn't she pointed out that basically your husband committed theft?....why hasn't she pointed out as wife you are financially responsible for your husbands debt?

what are you suing for? your husband owes the money and they are going to collect it. have fun losing this case.

then check the consumers rights. be informed before you call an attorny
