Maryland Civil Rights - What Can Be Done? |
If a person who is a roommate commits a crime without your knowledge and a Search/Seizure Warrant is conducted and person(s) other than the said criminal's property such as computers they did not have access to are taken and held for a pending case - can anything be done about it? Particularly for the victims who's property was seized even though the said criminal had no access to such? Is this a Civil Rights Case or what? Any input would be appreciated. Civil rights protections are guaranteed in law for protected classes (i.e., race, national original, age, sex, handicap status). In which category do you include yourself? Did the police act against you because of your inclusion in one of the protected classes? Ownership does not determine the lawfulness of a seizure. If a robber steals a gun and then committs a robbery, the gun can be seized and held as evidence, even if the owner wants it back. If you think that some property was unlawfully seized, or that it shoud be returned, start with a call to the cops. Failing that, call the prosecutor. Failing that, make a motion to the court for the return of seized property. If he property was lawfully seized, and needed as evidence, it will not be returned until the case is over. Why would a possible police mistake be a civil rights violation? Obviously they felt the perp had access and use of the equipment and the warrant issued allowed it. Get a lawyer, or talk to the DA. Not sure it is a civil rights, but clearly shows the OUTDATED mentality of the laws that they fail to draw a distinction between 2 parties who co-habitate and have separate privacy expectations under the same roof. This does not answer your questions but understand. Criminals have more rights than victims. Police in a criminal investigation will do all they can within the law to get all necessary evidence. |
