I hope someone can help me settle this dispute that I'am having with a" person" I know. ? |
This person is taking a medication that doesn't belong to her and it is a benzoazipine (zanax). The problem is she works and where she works they do not drug test!! She says it will be going against her Civil rights if they pull her to test her for drugs!!!! I say if they suspect her of drug use to bad for her and her rights. It is their right to drug test "if" they think she is on drugs. RIGHT or WRONG. Yes, they can drug test her, and she can tell them she takes Xanax (alprazolam) as prescribed by her doctor for an anxiety disorder. It's highly unlikely the employer will make her produce a prescription, and under HIPAA rules, the doctor can reveal nothing were the employer to call him or her. AS far as I know an employer can drug test it employees. If they do your friend could lose her job if she is taking someone else meds. If they think she is on drugs then yes they have "probable cause" to do a drug test on her. if it is stated company policy. in which case the worker was informed of it on hire. right Why is it any of your business? |
