Can someone who is an attorney or a paralegal answer my question below?


Ok, my former president refused to allow me to go to a relative's open house that they allow another relative of mine to hold at their facility. The president told me that I could not attend that open house because I am disabled and had filed previous complaints against the college. Which the United States Department of Education Office for Civil Rights found the president and the college at fault for Retaliation under Section 504. He told me that if I attended that open house than he would have me remove from his campus by the local police.

Ok, the owner of the defendants law firm wants to settle as long as I have a good attorney so should I settle or should I take it to court.

I have already supplied my attorneys with witnesses statements.

His refusal and his threats caused me to have severe anxiety, severe depression, severe panic attacks and to be hospitalized on the mental floor.

So, should I have my attorney settle like the defendants attorney who is the owner of the law firm wants to or should I have my attorney take it to court with my witnesses testifying.

The part of your question with regards to the owner of the defendants law firm want to settle as long a you have a good attorney is a bit thin. The defendants I am assuming are the president of the college and the college, is this correct? Are you stating that the defendents own the law firm that they are being represented by? If so, why do they wish to settle as long as you have a good attorney? Do you have an attorney that is already involved in this matter and if so, do you feel your attorney is qualified to represent you in this matter? (sorry, I just reviewed your question and see that you did state that you have an attorney, so please just answer the latter)

In addition, what kind of settlement are they offering you? Once you have clarified the questions I have listed above, I will be able to advise as to what avenue you should pursue. (settle or go to court)

After reveiwing the additional details that you added to your question I would advise that you do not take the offer to settle since you have once again been discriminated against and a possible conflict of interest exists. I would take it to court with your attorney present. Have you informed your attorney of this most recent incident? If so, what is he/she advising you to do? The only reason that I ask, is because attorneys tend to go the route which will make them the most money instead of what is in the best interest of their client. Also, from the information that you have presented in your question you have a very strong case that could provide you with the potential of receiving a great deal for damages.
