Can my employer have blood taken from me in a medical? ?


After an argument with some supervisors my employer removed me from work pending the assessment by a GP and psychiatrist. I have been stood down on full pay. I attended the psychiatrist appointment and that Doctor cleared me for work. The GP was quite happy also to return me to work, however, my employer has requested both a urine and blood test to determine if there was any organic or pharmacological reason for my out burst. I declined both, especially the blood test as that is invasive and the results private. The results have been requested by my employer. I have requested my employer provide a reference in regards to legislation to enable this to occur and they have cited the Work Place Health and Safety Act, Qld, Section 41. I read that section of the act and I can not see where it makes reference to testing blood and urine testing workers. I am now waiting for their decision. I work for the Qld Gov Dept. I am happy to submit to these tests if there is legislation, however, feel its over the top and a violation of my civil rights, ie privacy, comfort etc. Can my employer do this? If so is their an Act, Policy or Industry Code of Practice? We currently have no fitness for work policy outlining drug testing in the workplace.

LOL! Sorry! But if my employer wanted to and did that to me, after every argument! I would be bloodless and dry as a bone from those tests! I think some companies require urine tests, to make sure you are not on drugs, but the blood test, now that is something else! Besides, don't they recognize Doctor/Patient confidentialality!? And what about the supervisors that faced off with you!? How about THEIR reactions!? Don't wait around for their decision, get yourself an attorney! If they really want a blood test from you, they will have to go to Court and come up with a damn good reason for wanting it, and NOT just because you and they had a confrontation!! I can see employers asking that you take a physical, to make sure you are capable of doing the job, for safety reasons, even a urine test, but beyond that, they would be invading your privacy! I have found that Company doctors have a tendency to back the Employer, not the employee, you got the OK from the GP and psychiatist, assuming those two were the company's choice! If I was you, I would go to my own doctor and pick out a psychiatist, which I am sure you don't have one on hand! Get the damn blood test on your own, no Court will divulge any findings from that! That's YOUR personal documentation, not theirs! I don't know what the argument was about, but I wish I had been a fly on the wall!! Talk to your attorney, Good Luck!

This all sounds very sinister to me. I'd consult your citizens advice bureau. Do you belong to a union? It does sound like a human rights issue.
