Civil case?


Any legal workers out there? I want to know how many (what %) of civil lawsuit cases go to trial. What would make the parties settle? Is it better to go to trial, or better to settle for the defendants (in this case, the State in a violation of civil rights)?

No clear cut percentage that would apply, depends on what county you are in, what judge you end up with, the jury pool in your area, case facts etc. If you have an atty he should give you guidance about your chances of winning based on the strengths of your case and what is learned through discovery about the defense's case. Defendants usually settle to avoid court costs, to avoid testimony that would damage them in some way, if they feel they will lose or have a good chance of losing. The defendants also do not want negative case law against them to open up the flood gates for other suits....Look to your attorney for guidance...

maybe you could research the percentages online or something like that..'civil rights' 'lawsuits' civil law

It's better to settle out of court if you can. If not. you'll spend too much time in court and it might not go your way
