Car Accident Civil Compromise clears all?


So lets say I get into a minor car accident, I rear-end someone and there is no visible damage to their car. My car sustained a small dent on the front fender made by their hitch. I easily removed my plastic fender, pushed the dent out and no one has ever noticed.

They guy didn't mind and he signed a CIVIL COMPROMISE saying he released me from the civil offense. Basically it gets dismissed from course and no points go on my driver's license, hurray.

I went to get it dimissed today and I asked the woman if that meant he couldn't come back and try to sue me for more money. She said the civil compromise won't stand up in court.

I was wondering if anyone knows if she's right.

It seems ridiculous. If he says he was fully compensated, and that he releases me from the civil offense, he's obviously satisfied with how the thing was handled. Signing a civil compromise is OPTIONAL, so he optionally decided to dismiss the claim.

How could he possibly bring another claim forward

It does not settle any traffic citations you may have received.

The woman at the court house said that's the only thing it does. They dismissed the citation, it gets cleared off my record, doesn't go to court.

However, she said, the guy could still sue me if a year later he thinks he got back problems or something.


As for the insurance, I could understand that part.

However, on the a website for my city's Prosecutor's Office it says...
"A victim鈥檚 decision to enter a compromise is strictly voluntary and should not be entered into until compensation has been received."

So, I would think once he signs it...it means he's been fully compensated and I shouldn't have to face any other compensation he might come up with afterwards.

An adequate civil compromise settles all issues between you and the other driver.

It does not settle any traffic citations you may have received.

It also does not settle any issues between his insurance company and you if he filed a claim with his insurance company, they have the right to recover their expenses from you under subrogation.

If he tries to bring a civil law suit against you, the civil compromise should be offered as your defense against it.

If no police accident report was filed then there is no case.
