Couple To Get Arrested For Getting Married In Wisconsin?


Kathy Cox and Kim Wayland will be getting married 8/08/08 in California in a wedding for same-sex couples. They currently live in Wisconsin. Wisconsin has a law that you should know about.

The license is only available in California but a nearly century old law stating that if you leave the state to get married, you will be arrested upon returning for purposly leaving the state to get married. It is punishable by 9 months in jail and/or a $10,000 fine. This law was initiated in 1915, 5 years before women had the right to vote.
They said on CNN and CNN.com that they WILL BE ARRESTED for leaving the state to get married because it directly violates the law.

IS THIS RIGHT? DOESN鈥橳 THIS LAW INFRINGE ON OUR RIGHTS TO BE HAPPY? ISN鈥橳 THERE A FREEDOM OF MARRIAGE LAW? I FEEL AS THOUGH THIS LAW INFRINGES ON EVERYONE鈥橲 CIVIL RIGHTS. AM I IN THE WRONG?
Can anyone find information that says that this law would violate anything?

I feel that their best bet will be to counter sue the state for discrimination based on sexual identity and parade a stream of straight people who have gone to Vegas or Hawaii to get married in the court room that have not been prosecuted and whose statute of limitations would be up for prosecution. This will be a case that will without a doubt be appealed to the supreme court which is where changes to the law will have to be made. There is no "freedom of marriage" law and unfortunately there are a host of outdated laws such as this on virtually all state's books that need updating, revision and to be thrown out. I feel that this does violate their rights and that the state will be discriminating to target them such as this.
