Now days, how can lawyers tell the differences between a violation of someones "civil rights" and ...


....if someone is simply just defrauding someone? Plus how do you prevent someone from being falsely accused of "civics" violations, since it is much more taboo to violate someones civil rights.

For example:
A homosexual can say that a person is suing them mainly because he is gay, and that any other claims is a cover up for the real reason.

If someone is acting within the law and has enough evidence to substantiate such claims then it would extremely difficult for someone to throw a counter/civil rights violation at them. There are always people who will use any methods to try and pull the wool over peoples eyes but such smokescreens are rarely successful as they are based on lies! Unless there was an actual violation in the first place I think it is not common place to succeed in such counter claims/smokescreen tactics.
