Is birth control a civil right or a civil liberty?


This is an academic query, no flames or moral judgments please. A professor asked our class (hypothetically apparently) whether contraceptives fall under civil rights or civil liberties, and I am now extremely curious but also unsure of the correct answer! I am looking forward to hearing your ideas!

I am going to say it's a civil right. The first international document to mention reproductive rights as a subset of human rights was the Teheran Declaration, the Final Act of the UN's international rights conference. The Proclamation states: "Parents have a basic right to decide freely and responsibly on the number and spacing of their children and a right to adequate education and information in this respect". This right was adopted by the UN General Assembly in the Declaration on Social Progress and Development, by the World Food Conference in Rome (1974), as well as parlimentarian conferences internationally.

As for the person who said that you have no right to condoms, pills, etc if you can't afford them, this is not technically correct. County health departments offer birth control at low or no cost depending on your income as well as std screening, pap smears and breast exams, among the many other services offered there.

Civil liberty-
it's not a right- the best form of birth control is keeping your legs shut and that doesn't require anything but a personal decision.
