(T/F) The Miranda Rights Doctrine apply in a civil trial for assault and battery.?


i know this question is confusing but that is all the information i have for this question. please help.

Miranda rights are there to prevent a person from violating themselves by being interrogated by Police for criminal activities without having legal counsel present for their own protection.

A civil trial is strictly monetary. In a criminal proceeding, a jury has to be unanimous in it's verdict and uses "beyond a reasonable doubt" as the guidelines. A civil trial has to have a majority vote ( 7 out of 12 jurors) and uses a "preponderance of evidence" as their guidelines.

I cant see where Miranda could come into play in a civil trial. The Police are not going to sit a defendant down and grill him over a civil matter. It is not their jurisdiction. Entirely different scenario and different laws apply.

In answer to your question, I would say NO. Miranda is not applicable in civil matters.

Hmm, hard one. True in the sense you don't have to answer any self incriminating questions.

False in the sense if you said something to a party about the case, but you weren't mirandized at the time, it can still be used against you.

The Miranda rights strictly deal with interactions between police and suspects in the course of a criminal investigation.
