In constitutional law, a valid exercise of police power must pass the clear and present danger test. Right, it may come as a surprise to many but 鈥渃lear and present danger鈥?is actually more than a Tom Clancy novel and a movie that starred Harrison Ford. It is one of the most important legal doctrines laid down in jurisprudence. In essence, the clear and present danger doctrine says that the state cannot interfere with the exercise of civil rights of the individual unless the individual, or individuals, commit an act that imminently threatens the existence of the state or the normal processes of the law.
