Child Custody even if the mother is a minor?

Ok so to start im a 17 year old mother. My mother died and i have been living in my apartment for 3 months on my own paying bills and rent in full. its a nice place not dirty or in a bad neighborhood at all.

my true question is what are the chances that a father of my son who is 22(the father is) that has not worked upuntill about7 months ago who is woking for min wage and living with his mother coulod get custody? He never paied child support and now is all father of the year wanting to see him and crap. Like he is an ok guy but we live 3000 miles away from each other. I dont think he stands a very good chance at all....but im not sure

Yeah, I told him I was like your the adult im going to school working taking care of our son....why dont you get off your asss and come see him if you want to? Its stupid.

Thank you guys

He cannot get custody. In addition he should be paying child support. He could still be prosecuted for statutory rape for fathering your child. Please don't worry, he cannot get custody. If a man doesn't support a woman while she is pregnant or the child after it is born, courts have held that he has abandoned his child.

The state will file for child support on your behalf.

Look into a Divorce lawyer (no really, they handle custody cases, so they are perfect).

A judge will not award custody (full) to someone who can't demonstrate a willingness to support their child. If he has no job, isn't earning enough, and living with mom, and his past record of not paying child support, will show the judge what he is really about.

Get a lawyer.

Since you were never married you automatically have full custody of your son. You have been the childs primary care taker since birth and you can financailly, physically and emotionally take care of your child. You don't have anything to worry about, no judge would take a child away from a responsible mother just because the dad all of a sudden decides to grow up
Good Luck

Do you love your child enough to support him or her? If you do, you already have evidence of that. nuff said.

Dad would have to prove that you are not a fit mother, to take baby away. Since you are supporting your child, WITHOUT CHILD SUPPORT, that tells a whole big story, doesn't it?
By the way.. jurisdiction for any child case is where the CHILD lives. Does he have money to come where you are, file against you, and probably lose? Plus the possible charges of statutory rape, if he stirs up crap.
Your job is being a model mom.. not partying, or anything that might remotely neglect your child. Sounds like you already are doing that.
Don't let him intimidate you.. that is what he is doing, playing on how young you are.
