I'm a single mother who needs help with child custody issues?


My son's dad has 5 other kids from 2 different women who he doesnt see nor care to be with. He is making me miserable bc he fought his rights as a father after I filed for annulment. He choked me in front of my son that is why I had to leave him. He also lied to me about his 2 other families after being married to him for 2 months. He was still married to the 1 of the ladies who he has 3 kids with. When we settled the annulment the court allowed to give him one week of visitation rights per month. This is only a temporary agreement. I'm not understanding the part on when this temporary agreement expires. I should get my official annulment decree within 30 days. Once I get the Annulment official is that mean he doesnt have to have my son for a week until he files a petition at Juvenile? Will I get in trouble if I dont let him have my son for a week. I cant trust him leaving my son with other people for that week when he goes to work. My son is only 18 mos old. Has anyone been thru this?

I'd say you need another attorney (or it could be this one wasn't much help because there's not much they can do until the annulment and permanent custody arrangements).

Another option is to try to settle outside of court where you tell him you'll release him from child support if he gives you total custody. This would probably need to be drawn up by an attorney, but would save you tons in legal fees.

Well, as long as the father is paying child support he has legal right to see his son. I am sorry you were hurt by his lies. I had a similar situation where a man lied to me about his marital status. He was married and lied and told me he was divorced. It did shatter my trust as men love to lie and have an affair and the women end up hurt.

The temporary custody order does not expire until it is replaced by a permanent custody order, which would probably be entered at the same time as the annulment decree.

Although you can come to an arrangement out of court regarding how you and he wish to proceed regarding custody and support (which arrangement will need to be in writing and filed with the court as a settlement agreement), custody is NOT tied to child support obligations, and he would be entitled to visitation even if the court did not order him to pay child support.

You will be in trouble if you deny him visitation rights which he is entitled to, either under a temporary or permanent custody order. You can be held in contempt of court for disobeying the court order and subject to any number of punishments in the judge's discretion.

You can seek the help of another attorney if you want to pursue more restrictive visitation rights for him, but I doubt that you will be successful based on the facts you described, and it would probably result in a lot of wasted money on legal fees and emotional strain on everyone. That he has to work during the week that he has visitation will probably not be considered a sufficient reason by the court to deny him his rights to visitation with his children.
