I need help in child custody in ontario???? |
I have a 5 year old son, and his father left us when he was 9 months old and now 4 years later, hes father wants to start seeing him. i dont know this man anymore and i dont want him to see my son. Does any one know he would get rights if was to take me to court???? Please I need help.... He is the father of your son, and since it sounds like neither parent has full custody of the child, then he has every right to take you to court. Perhaps instead of panicking, you should sit down with him and talk to your ex. And when you do go to court fight for full custody for your son, your ex has to prove that you are a un-fit mother in order to completely take him away. But you shouldn't hold your son back from having a relationship with his father. If you are completely uncomfortable with the idea then start with your ex coming over to your house and visiting with your son there, and then gradually having visits from there. Start slow, but don't try to interfere with their relationship. It's his son as well and the court will recognize that. They will also recognize his complete inaction and lack of child support in previous years. Expect to be awarded back child support but to have to share your son. My guess is that you would retain full physical custody while he'd get some every other weekend arranged visitation - probably supervised at first. Hopefully if he's not a good influence to your son, his family will be. If this case were in Virginia, USA then it would probably work out to where if he got ANY visitation, it would be extremely limited (couple hours every 2 weeks or something) and then only supervised. More than likely a Guardian Ad Litem would be appointed for the child...this attorney acts in the child's best interest, investigating the parties involved and making recommendations to the court. |
