Is there any way to prevent my ex-husband from declaring bankruptcy if I win the lawsuit against him? |
I was told that if I win more than $30,000 against my ex-husband that he will most likely just file for bankruptcy. Is there any way I can prevent that from happening? Or should I just settle for a lot less ($30,000) than he really owes me? I prefer an answer from an attorney. Thanks! if he was your husband , how does he owe you? No you cant stop him from filing for bankruptcy as long as he meets the requirements You can't prevent him from filing for bankruptcy. You may have other avenues of recourse if he files after you are awarded a judgment. How much does he actually owe you and why? So in order for your greedy *** to be happy you have to ruin the man? If you have a lawsuit against your husband, I suggest you consult your attorney. you should settle for less just to get it done and be on the safe side. Unless he is financially well off he would probably file bankruptcy. After that i belive the only thing you can do is fight it and try to get the judge to belive again that you are entitle to it and that he can afford to pay it to you. I will not comment on your personal status because if you pose the question then i would believe you were entiltled to the money or atleast think you are. Either way if you deserve it and it is yours..fight to the end or quit and settle not sure WTF, your sueing him, and he is so broke that he is considering filing bankruptcy, and YOU want to prevent him from doing so, just so you can get more money from him? Why don't you just leave him alone, obviously he doesn't have enough to pay your money-hungry gold-digging ***. You could try giving him back the 30 g's Bankruptcy isn't my area of expertise, but just because he declares bankruptcy doesn't mean he will not have to pay you. oh teh nos! my ex is goin bankrupt so i iz scared i won get his last dime from his cold, broke fingers! whuteva shud i do? sue for 29 thousand dollars |
