Divorce and Bankruptcy any suggestions?


My husband and I have been married less then a year. During the entire marriage he has been deployed, and I didn't work (I was in school). He wants to file a non-contested divorce but he wants me to pay him like $10k (at least) to go back towards the car he purchased for me, and the money he gave me while he was deployed, or he wont do a non-contested divorce. I will talk with an attorney as soon as I find one, but wanted to get suggestions now. I just want to be done with this mistake I made and I don't want to fight, but I don't have $10k to give him. My credit is really bad (from several stupid things when I was rather young). I have thought about filing bankruptcy, I guess my question is, is if I placed the amount he wanted in the divorce papers just to be done with it can I include that amount in my bankruptcy? Oh, I live in WA state if that information is needed. I am scared and confused and really don't have much money for an attorney as he has completly cut me off.

I am not trying to take the easy way out with either the bankruptcy or the divorce. My husband cheated on me (and yes a man can cheat on his wife while deployed to Iraq) and I have proof. I also have countless (sexual) emails to many women while we were married. One of those emails was even to my sister.

I go to school full time (that I paid for) and take care of my kids (not his). I am 3 weeks away from finishing, and I have a few job offeres lined up. However, I have no way to pay $10k (or more as it does change) in 3 months, or even 2 years. He also does not want the car back, he wants a truck not my car. he did say if I buy him a truck and a set of Golf Clubs he will be ok. He has also stated he will file charges for using his bank account and his debit card for purchases made while he was gone since I was not on the acct (I do have a POA). I will seek advice of an attorney, but just wanted to see what others thought.

OK, you have LOTS going on... :) First, if you promise the 10K in a divorce doc, it will have to be paid before the divorce finalizes, so that won't work. It also can be considered "not acting in good faith" if you say you'll pay it then file a chapter 7, which judges don't like, at all.

Bankruptcy is federal court, so that is a whole different proceeding than a state divorce court, you can do one while you're doing the other but it's messy messy messy and it will take 3 times as long. You're better off waiting on the bankruptcy filing and see if you really have to do it or not after the divorce is final.

Your best bet is to take it to a divorce attorney who will stop soon to be ex hubby from threatening you with legal action he probably can't afford either, and if he really did pay for the whole car give him the damn thing back as part of the divorce settlement and wipe your hands of the whole thing.

Good luck, hon, get a reasonable divorce lawyer that will work with you and it'll be over in a few months.

don't file bankrupt.keep your head up and work hard to pay off the bills.you may have to fight this divorce in court.

It would be difficult but could be done, if you do not have the money for an attorney contact several and you might find one who will take the case Pro Bono to satisfy their monthly requirements.

If you have the car, then you do owe him for half of it. Just talk to an attorney and get it done. There is no point continuing the marriage. You don't have enough debt to go bankrupt. Just get a job and a second job and get this done and behind you. Quit looking for a easy way out.
