Is this bankruptcy fraud??


My father just declared bankruptcy. When he was deciding to file he asked his father to change his will so that if he passed away the inheritance that was left to him would not be collected by the courts. His father had cancer and died about 1 mos after my father declared bankruptcy. His father did change the will so that the estate would be left to my sisters and I instead of my father. Now I am wondering about bankruptcy fraud. Can my sisters and I legally just hand over a large sum of money without getting into trouble?? Could my father get into trouble if the courts found out about the change. The estate was originally suppose to be left to my father. I am just really confused, and definately do not want to get into trouble.

Not fraud; there was no way to know the man would die and the cash would be an asset during the bankruptcy. No law says you have to give him anything. If you hand him anything before the bankruptcy is closed, it will be applied to his debts; and after it's closed, it can still be reopened by a creditor if THEY feel a fraud is happening

You can only give $11,000 a year without having to pay taxes on it. If it is more then that, the recipient has to pay taxes on it. That is the only problem with what you are looking to do. Also, if he is still in bankruptcy, don't put money into an account with his name on it.

If it is more then 11,000 then give it to him over a course of how many years
