My bank cashed a check that was stolen from me!! Could I sue them?


Aperantly someone stold one of my blank check out of my purse while in a dinner party. The person who stold it wrote on the check "Pay to the bearer". He made the check for $500.00 and cash it. There is no way of me finding out who did it because apperantly the bank did not ask for an endorsment when the person came to cash the check. They argue that the check was perfectlly negotiable and they were well within their rights to accept and cash it. What can I do? Friends tell me to let it go but I feel violated by the bank and by the person who stold the check. Can the bank choose not to ask for an endorsment? I though this was a requirement for cashing a check. Please help.

I found out about the check when I got my bank statement. On the bank statement there was a copy of the check ..without and endorsment.

Thing is right. Try contacting the bank headquarters or something. The fact that the bank would try to justify it would piss me off even more. Go for blood. good luck

Edna, Edna, Edna, I have NEVER heard of a bank not wanting an endorsement on the back of a check when paying out cash on that same check. It is just not done! Now, what is REALLY going on here? IT IS A FACT THAT YOU HAVE A LEGAL RIGHT TO A COPY OF THE CHECK. Come on now, are you the one with the blank check????

On top of what the other answers, I would also find a new bank. It's obvious that that one isn't looking out for its customers if it's that easy to walk in and cash a check without endorsing it or anything.

Your bank has a responsibility to compensate you for the full amount of the stolen check. If they do not then you must sue them.

Under the UCC, the bank is liable for accepting a forged check.
