I was sued I cannot pay the whole amount because I don't work. She is reviewing by banking account.Now what.


I have never work. The person said not to worry about the money until I started working. Things changed. She wants to check all my finances etc. Does this include my hubsands also even though he is not part of the suit. I have to return to court with these documents. I send her $50 a month. I owe her about $4400.

Pay no attention to the jazz about your husband's liability for the debt. Unless the debt was incurred for necessaries at a time when he wrongfully absented himself from the marital abode, he has not liability on the debt, regardless of when it was incurred.

Since your husband is not liable on the debt, his finances are not relevant to the enforcement proceeding. However, if your banking accounts are jointly held, you will need to adjust that, because the creditor can seize any account on which you are named as a depositor.

I'm curious about "these documents." You have no income. I assume you have no assets. You are wholly dependent on your husband' income. What documents could they be asking for beyond your income tax return, which presumably will validate that you are without income.

Apart from the possibility that your checking account is jointly held with husband (fix that if it is), it seems that $50 per month is more than they can hope to collect by force, I would tell them as much.

First off, you need to get a job -- any job -- to show that you're making an effort. They're going to check your husbands finances as well, since y'all are joined, even though this isn't his debt -- he still might be expected to help pay for it.

You just need to start making payments as promised.

If you don't and they find out you have money they might start to garnish wages...

This is perfectly legal and necessary to determine if you lied about your finances or not.

Also, although they cannot attach anything that your husband owns, that only will apply if this is debt you incurred BEFORE marriage. If the debt was incurred during the marriage then you AND your husband are both severally liable and joint accounts can be attached as well as joint assets.
