Aviation Law

The Legal Profession

July 17th, 2009 at 02:51am Under Aviation Law

Once fully trained in matters of the law and legal system, a person is called a lawyer; also known by the names, attorney or advocate, their role varies depending on the situation. Lawyers can perform many roles which can include representing a client in a court of law (advocate) for either criminal or civil matters; not all want or will appear in court whilst others dedicate their whole lives to courtroom appearances. When advising on the issues relating to the law they become legal advisors; this is usually when client requires guidance and possible courses of action.

One who primarily practices law in a courtroom is a trial lawyer; owing to the fast thinking that is required by those who practice this area of law, it is not for everyone.Much of a trial lawyer’s work is actually performed outside the courtroom environment; they investigate evidence and interview people involved in the case.

The legal system affects nearly every aspect of our society; whether you are buying a house or making an insurance claim, but because lawyers are in a position of authority they must abide by very strict rules to govern their conduct. Depending on what area of specialization they work in will decide whether they practice in a courtroom; although they are all able to represent their clients in this manner when required.

Lawyers can specialize in a number of different areas of society; some of the areas of specialization could be: Probate,Aviation Law,International law,Marine Law and Construction Law.

The number of specialist areas of law is also the reason why only a few ever practice in a courtroom!

Environmental law for instance employs experts who will represent private, government and individuals; an example of this group could be construction firms, utility companies, and large corporations.

These help clients prepare and file for licenses and applications for approval before certain activities may occur; they also represent clients’ interests in administrative adjudications.

Attorneys are also involved with laws protecting intellectual property rights, an area much in the news of late; property like digital media, CD’s, computer games and software for instance, are particularly at risk since the advent of the Internet. Major insurance companies usually employ lawyers in their legal department; insurance terms and conditions often change to protect the company from fraudulent claims but they can also be useful performing insurance investigations.

Much of law might be considered mundane as the majority of attorneys carry out their work in private practice involved with minor criminal and civil law. criminal lawyers try cases or defend the accused party; whereas civil law affects areas like wills, trusts and mortgages for example.

Where there are high profile cases that may affect the public, or be in their interest, other legal specialists operate; these might concern large companies for example where their image might be at risk. Lawyers who are endowed with a little more social conscience are the ones who work for charities and legal aid schemes; this type of work is more about helping those are not able to have legal representation any other way.

What Is A Lawyer And Why Should I Use One?

July 16th, 2009 at 08:51pm Under Aviation Law

Trained in law and able to give legal advice, lawyers are also referred to by other names; they are called attorneys in The United States and on some occasions, advocates or advisors. The term advocate is used when a lawyer acts on behalf of the person he is representing in a courtroom; for many, this is not something they wish to pursue, passing over cases to others that prefer this type of legal representation. When employed to provide advice on the law they are known as legal advisors; this can just be to provide clarification surround a legal matter.
Trial lawyers have greater familiarity with courtroom rules and strategy; owing to the fast thinking that is required by those who practice this area of law, it is not for everyone.Trial lawyers are extremely competent individuals who are just as proficient outside the courtroom; they investigate the case they are representing, talk to witnesses and arranging evidence, for example.
Our entire society is affected by laws and the legal profession; this is why lawyers are held in high regard but they must live up to this by living and working by a strict code of ethics. There are many specialized areas of law which they can focus; however, all can and do appear in court from time to time to represent their clients.
Many areas of law now exist to meet the needs of a complex society; examples of just a few are show below:
Probate, Aviation Law, Civil Law, Marine Law, Identification Theft. The number of specialist areas of law is also the reason why only a few ever practice in a courtroom!
Those specializing in environmental law for example might watch out for the interests of organizations on either side of the argument; a few examples are listed here: Waste Disposal Companies, U.S. Environmental Protection Agency, Airports. Often this work will be mundane as it involves planning applications and licenses for example; however, they also protect companies where claims for damages are being sought.
Of course one of the cleaner areas that attorneys are involved with is intellectual property rights; it covers digital images, songs and videos; in fact anything that is available on the internet. Major insurance companies usually employ lawyers in their legal department; insurance contracts and claims are often investigated which is an are where their expert knowledge will be invaluable.
The vast majority of attorneys work within the private sector where they can devote their energies to either criminal or civil law; criminal lawyers defend or prosecute persons charged with a crime; whereas civil law affects areas like wills, trusts and mortgages for example.
Where there are high profile cases that may affect the public, or be in their interest, other legal specialists operate; these cases may have an impact affecting communities in general, not just an individual, and can involve anything from government regulations to property interests. Lawyers who are endowed with a little more social conscience are the ones who work for charities and legal aid schemes; this type of work is more about helping those are not able to have legal representation any other way.

Frames Over Forty

July 16th, 2009 at 02:51pm Under Aviation Law

As we age, the likelihood of wearing glasses becomes more of a reality. When worn all the time they also become our most important accessory. Unfortunately, the wrong frames can date us, as well as our eyewear. For a more youthful look consider style, fashion and colour. Defy gravity with a little face lift. Keep them guessing your age, by choosing styles that keep attention upward and outward on the face. ? Upswept styles do just that. They visually lift the face making you look younger.? Eyewear with heavy bottoms or a downward sweep such as aviator styles are best left for the young… not the young at heart. Avoid styles that focus attention downward.? An extra touch of colour on the upper frame or outer corner creates a focal point.? Arms attached at, or toward the top of the frame, accentuate the cheekbones and open up the face.Choose styles and weights that complement your face and features while keeping up-to-date with society. ? Keep in sync with style trends. Even classic styles become dated over time. Update frames as fashion changes.? For a more youthful look, size up the size of your frames. It’s important to choose eyewear that complements your personal scale. When small frames are in vogue, wearing ultra-large styles can make you look older, and vice-versa. ? Gone are the days when one pair of glasses will do. Like shoes, your eyewear can’t be right for every occasion. While you may have your favorites, freshen up your look with different frames for different activities or occasions. As we age, our features and colouring generally soften. Colours once worn may appear harsh. Choose colour carefully to bring out your best.? Complement your personal colouring with frames that repeat your softer skin, hair or eye colours. Shine, lighter visual weight and rimless glasses, also work well. ? Avoid heavy, dark or dull colours which tend to pull the face downward. If you love black, opt for gun metal, deep brown or burgundy instead.Glasses can have big impact on how we are seen. Choosing the right eyewear will ensure that you appear chic and timeless.

A San Diego & Orange County California Airplane Accident Lawyer’s Humorous View of Possible Future Laws to Prevent Aircraft Accidents

July 16th, 2009 at 02:52am Under Aviation Law

If you’ve had an airplane or aviation accident anywhere in California, from San Diego to Orange County, or from Santa Barbara to Palm Springs, or at any other Southern California airport including Carlsbad, Chico, Imperial, Long Beach, Los Angeles, Ontario, San Luis Obispo, Santa Ana, Santa Maria, Palmdale, Camarillo, Chino, Compton, El Monte, Hawthorne, La Verne, Ramona, Riverside, San Bernardino, Torrance, Upland, Van Nuys, Burbank, Apple Valley, Banning, Big Bear, Borrego Springs, Calexico, Corona, Lompoc, Murrieta, Temecula, Oceanside, Paso Robles, Redlands, Santa Ynez, Twentynine Palms, Hesperia, Joshua Tree, or Yucca Valley, you’ve probably been wondering if the California state legislators are working on any new Bills to try to prevent airplane accidents or if the cut backs on food and drinks on flights means that safety might also suffer.

I had heard that the state’s legislators were rushing to pass laws to prevent airplane accidents, so I called one of my state Senators to learn how this would affect pilots in California and personal injury victims. What I learned may just keep me on the ground in the future.

“I would guess that the rule against using cell phones won’t apply to pilots, right?” I asked.

“Actually, it will,” the Senator said. “We still think it can mess up the navigational equipment. Radio transmissions will still be allowed.”

“What are you thinking about prohibiting?” I asked.

“Can you keep a secret,” the Senator asked.

“Sure,” I said.

“Well we’ve heard some pilots used to like to drink a little something on long flights,” the Senator said.

“You’re not saying what I think you’re saying, are you?” I asked.

“Yup,” the Senator answered. “No more beach parties in the cockpits. The rule against drinking margaritas will be strictly enforced from now on.”

“That’s good,” I said sarcastically. “I hate it when the pilot of my plane starts singing on the intercom.”

“What else are you thinking about prohibiting?” I asked.

“No more gambling, and no more card games of any kind.”

“They play card games up there?” I asked.

“They play all kinds of games,” the Senator said. “Poker, video games…we’re making a list that will be all inclusive, we hope.”

“So what else are you considering outlawing?” I asked.

“Well, you’d probably be surprised what pilots do now that they have all that food to themselves,” the Senator said.

“You mean the food they used to serve passengers?” I asked.

“That’s right,” the Senator said. “Turns out they’ve been having food fights up there and using the peanuts as poker chips.”

“Sounds like the fun is over” I said.

“We’re not prohibiting everything,” the Senator said. “But there will be no more spying on the passengers unless it’s for security reasons.”

“What do you mean spying?” I asked.

“Are you sure you can keep a secret?” the Senator asked.

“Positive,” I said with my fingers crossed behind my back.

“Well, you know those little air vents that you adjust to blow air on your seat?”

“Sure,” I answered.

“Lets just say that airplanes vents would do more good if they didn’t have little cameras in them.”

“You mean that each of those little vents are really cameras?” I asked. “I always wondered why they worked so poorly.”

“You didn’t hear that from me,” the Senator said.

“Aren’t you afraid of making the pilots bored if you take away their little spy tools?”

“Maybe they’ll have to put on some better in flight movies,” the Senator said.

“Just don’t let the pilots have a screen to watch them,” I said.

“Good point,” the Senator replied, and made a note to himself.

Laws Can be Tricky for California Aircraft Accidents That Occur

July 15th, 2009 at 08:52pm Under Aviation Law

As we all know, when any type of unfortunate aircraft or helicopter accident occurs, it is generally a very serious incident and most always results in very serious injury and usually numerous fatalities. It is a very serious thing for any family to experience, when a loved one has been involved in an airplane or helicopter crash.

Even though this type of travel is considered to be one of the safest means of travel, according to the Federal Aviation Administration or FAA, accidents involving aircraft and the personal injuries that individuals suffer, including wrongful death are expected to double over the period of the next twenty years.

Most individuals may not be aware of the fact that serious injuries which involve the smaller types of aircraft happen much more frequently than accidents involving the larger aircraft, but most of these accidents go unreported. As a matter of fact, at least once every single day, a threat of some type is reported in the United States, or an accident occurs that is safety-related, and a majority of these are not reported.

Laws can be tricky that surround California aircraft accidents that occur, and it is in your best interest to contact only experienced aircraft accident attorneys who have the utmost in experience and knowledge in these laws. Los Angeles personal injury and wrongful death attorneys serving Southern California and beyond, can help you wade through the frustrating legalities of treaties, laws, and regulations that can be experienced when it comes to the tragedy of an aircraft or helicopter accident and the injuries that can be involved.

There are many situations that can play a part in the cause of many of the serious injuries or wrongful death suffered in the aircraft crashes that happen today. Depending on the specific situation surrounding the airplane crash, this will help in determining potentially liable or negligent parties that could be held legally responsible. Some of these may include component parts or other problems with the helicopter or aircraft which can lead to accidents, bad weather conditions, or even pilot error.

In cases where component parts of the aircraft prove to be faulty, the manufacturer of the aircraft could be held responsible, or possibly the component part manufacturer may also hold legal blame. The operator or the owner can hold liability, as well as the federal government. Only the specialized experience of California airplane accident or helicopter accident attorneys can assist you in determining these factors. Due to the vast amount of aircraft accident emanating from LAX, Los Angeles airplane accident attorneys are of the personal injury lawyers in Los Angeles who are fighting for the right of consumers. Los Angeles accident attorneys also are located next to the Central District Federal Courts where many airplane accidents are litigated.

Different Aspects of Personal Injury Laws

July 15th, 2009 at 02:51pm Under Aviation Law

Personal injury laws are defined at state level. A panel of judges and the members of legislatures sit together to create, modify and amend the laws. Personal injury law of one state may not be the verbatim copy of that of another state; personal injury laws of California may not be same as that of Florida.
However, state laws share a lot of similarities as well. While defining personal injury laws, generally three torts are taken under consideration – international torts, negligence torts and strict liability torts.Three Torts in Personal Injury Laws:
International torts deal with the cases in which the offenders are aware of the consequences of their actions while committing it. The action is intentional. Assault, household physical and mental abuses and workplace bully fall under international torts.
Negligence torts consume the lion portion of personal injury laws. Most personal injury lawsuits are based on negligence torts. The law makes it compulsory for all the citizens to act responsibly and reasonably that any other person would do if placed in similar situation. Simply put, everybody should behave rationally and sensibly so that others do not get affected for their behavior.
For example, a reasonable person would always take steps to remove traces of oil, water or grease from the floor which accommodates a lot of people everyday. Now, if a restaurant owner fails to do so and anybody slips and falls on the floor, the owner is held responsible for negligent behavior under negligence torts. And you can sue the owner in Florida for compensation under the guidance of personal injury lawyer Florida.
Strict liability torts deal with a different type of behavior. Here, if the behavior of one person does any harm to another, the victim can sue the offender under strict liability torts. Because his actions injured someone else, the defendant is held guilty. Points like whether he was aware of the consequences or he was not able to conform with normal standards are not at all considered. Personal injury laws for malpractice:
Apart from torts, personal injury laws in America protect the citizens against professional malpractice. Medical malpractice and professional malpractice laws have been introduced to stop unethical and wrongful actions of professionals including medical practitioners.
Personal injury laws also deal with product liabilities. This section entitles consumers sue the manufacturer of a defective product which caused damage and injury to the users. When a person buys a chair from a furniture store and falls from it while sitting because the legs of the chair were broken, the consumer can sue the furniture store or the manufacturer for compensation.
And there is a part of personal injury laws that deal with transportation laws. Automobile, rail road, maritime and aviation accidents cases use this part of state personal injury law.How to make full use of personal injury laws:
To make full use of the personal injury laws, you need to understand the section that best suits your case. You have to decide whether negligent tort or the transportation law is the right ground for your compensation claim case.
Feeling lost? Do not panic. It is quite difficult for general people. So take help from personal injury lawyers of your state. State attorneys know the state personal injury laws better than anyone else. If you are from Florida, seek help from Florida attorneys to get your compensation claim filed in Florida court of law.
Generally, personal injury lawyers and law firms do not ask the victims to pay attorney fees while filing compensation claim. They collect their fees from the compensation amount at the end of the case. However, you may need to pay court costs and some other fees. So talk to your attorney about the costs; go ahead and apply your rights.

Law Enforcement Pilot as a Career

July 15th, 2009 at 08:51am Under Aviation Law

How does one actually become a law enforcement helicopter of fixed wing pilot? This is a question asked by many young people who one day aspire to be a pilot, or more specifically a law enforcement pilot. The standard answer you will hear, is that most police agencies “hire their pilots from within.” This is true for the most part but let’s take a closer look at this possible career choice. Another related question I see often is how much do law enforcement pilots make?
Indeed there are some agencies who hire civilian pilots. We will take a closer look at this in a future article.
First let’s look at where most of the law enforcment pilots are found in the United States. By far the vast majority are found in state and local law enforcement agencies. In other words your local police and sheriff’s department, or your state highway patrol. Yes there are a number of federal agencies who employee pilots, but the vast majority are local law enforcement agencies.
Take LAPD (Los Angeles Police Department) for example. They operate approximately 18 aircraft, most of which are helicopters, and have somewhere in the neighborhood of 70 people assigned to their aviation unit. They are one of the largest law enforcement aviation units in the country, if not the largest.
I probably don’t have to tell you that the helicopter dominates the law enforcement aircraft inventory, though many agencies will operate one or two fixed wing aircraft for prisoner transports and surveillance operations. So the majority of law enforcement pilots are helicopter pilots.
The vast majority of agencies do in fact take their sworn officers and deputies, and either train them in house, or send them to flight school to obtain their helicopter pilot license. Why do they do it this way instead of just hiring people who are already pilots? Well I can’t answer for every agency, but suffice it to say that the majority do, do it this way and they have for many years.
So how long would you have to spend on the ground as a patrol officer before being able to transfer into a law enforcement air unit? This varies significantly from agency to agency. There is usually a minimum amount of time, such as 2 or 4 years, and then there is the actual time and experience you will need in order to be competetive for such a position. I know of some law enforcement officers who were able to transfer into their air units with as little as 5 or 6 years on the department.
About that pay. Most law enforcement pilots do receive a premium pay for being a pilot in the air unit. However, all you really need to do is look at the salary of a law enforcement officer on a large department with about 10 years on. This will give you a good idea of what a law enforcement pilot makes. Depending on the part of the country I would estimate most law enforcement pilots are making $60,000 to $70,000 at a minimum. Some make much more. Ultimately, law enforcement and law enforcement pilot are excellent and rewarding career choices.

China new labor law being questioned again by pilots

July 15th, 2009 at 02:52am Under Aviation Law

This has become one of the hottest news in China nowadays since the explanation cannot be accepted by the passengers affected by the delays, as many of them have decided to take the airline to court.

The official weather report indicates that weather is good enough for the landing on the days above event took place. All flights from other airlines have landed in the same destinations.

On April 1, 2008, there are another 4 flights from the same airline played the game again. It is said that there are more pilots joining the strike to support the early pioneers.

Previously, on March 14, more than 40 Shanghai Airlines pilots called in sick, as did 11 pilots from recently established Wuhan East Star Airlines on March 28, the two sick-outs together resulting in a slew of flight cancellations.

Today, China Easterm Airlines, for the first time, have acknowledged that the event might not only caused by the bad weather. If they confirm pilots intent to do it, the airline will punish the pilot and might forbid them from any more fly.

This event has caused disputes again on the impact of the new China employment contract law which have given the employees more freedom and less liabilities when changing jobs.

A boom in air travel means China is increasingly short on pilots, while cut-throat competition between airlines keeps their profit margins tight. The newly established private airlines are willing to buy the readily trained and experienced pilots from big state-owned airlines and pay the compensation. This, actually, have no conflicts with the new Chinese employment contract law.

Following the Hongkong, Taiwai, South Korea invested manufacturers shutting down their factories in China and move to lower cost countries, the China aviation industry has become another industry that questioning the new law.

Aviation Employment As A Helicopter Pilot

July 14th, 2009 at 08:52pm Under Aviation Law

Aviation Employment as a Helicopter Pilot

Becoming a helicopter pilot involves a much different type of training than the more traditional pilot’s license. The ability to safely control a helicopter both in the air and at landing sites is imperative and requires a different skill level than a commercial pilot who typically has a standard landing and takeoff location that is well marked and prepared for their arrival. Helicopters may be used for a wide variety of purposes and consequently a helicopter pilot must be prepared to handle any number of conditions and situations.

Just as with traditional pilot jobs, helicopter pilots have a number of different areas that they can focus on for employment. For helicopter pilots that want to work with medical emergencies, hospitals typically enlist a private service to handle their emergent air lifts. The helicopter pilot is typically contracted to the hospital or to an emergency medical unit company.

Aviation employment for helicopter pilots can also be found with organizations that provide search and rescue assistance for local law enforcement agencies or government agencies that support areas such as the national parks. These types of helicopter pilots typically have to be trained for jobs such as mountain rescues, avalanche search and rescues, supporting efforts in dangerous areas including wild fires. Other specialized helicopter skills that can help a pilot when seeking aviation employment is the ability to support water rescues and night flying for spot light or heat sensitive searches.

Being a helicopter pilot isn’t all about the adrenaline rush from emergencies. There are also opportunities to work for news agencies, particularly for assistance with traffic reporting. The travel industry also utilizes helicopter rides for private events, such as private, picturesque views of major city skylines. Some industrial and corporate opportunities exist for helicopter pilots who would provide transportation into or out of difficult areas for people or for supplies such as in the mining industry. When seeking aviation employment, it can be helpful to truly determine what type of pilot you are interested in being, whether it is emergency assistance, private support or the travel industry.
